1. Agreement to Terms
1.1 By accessing or using the services provided by A Plus Services LLC, DBA as Rocket Boyz (“Company,” “we,” “our,” or “us”), including our website, marketing automation tools, CRM platforms, AI-powered chat bots, and any related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use our Services.
2. Description of Services
2.1 Rocket Boyz provides AI-powered local marketing services to home service businesses, including but not limited to: lead generation and management, automated chat bot communications, CRM setup and management, advertising management (Yelp, Google, Meta), website design and hosting, and SMS/email notifications and alerts.
3. Eligibility
3.1 You must be at least 18 years of age and have the legal authority to enter into these Terms on behalf of yourself or your business. By using our Services, you represent and warrant that you meet these eligibility requirements.
4. Account Registration and Security
4.1 To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials confidential.
4.2 You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
5. Consent to Receive Communications
5.1 By creating an account or using our Services, you expressly consent to receive SMS messages, email communications, and other electronic notifications from Rocket Boyz related to your account, lead activity, engagement alerts, and service updates.
5.2 Message frequency varies based on lead activity and account settings. Message and data rates may apply.
5.3 Opt-Out of SMS:
You may opt out of SMS communications at any time by replying STOP to any message. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to start receiving messages again, you can sign up as you did the first time.
5.4 Opt-Out of Email:
You may opt out of email communications by clicking the unsubscribe link in any email.
5.5 Assistance with Text Messages:
If at any time you forget what keywords are supported, just text “HELP” to the number from which you received the messages. After you send the SMS message “HELP” to us, we will respond with instructions on how to use our service as well as how to unsubscribe.
5.6 Opting out of transactional messages may limit your ability to use certain features of the Services.
5.7 No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
6. Acceptable Use
6.1 You agree not to use the Services to: (a) violate any applicable local, state, national, or international law or regulation; (b) send unsolicited messages (spam) or engage in any activity that violates the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or any other applicable anti-spam or telemarketing laws; (c) transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable; (d) impersonate any person or entity; (e) interfere with or disrupt the Services or servers connected to the Services; or (f) attempt to gain unauthorized access to any portion of the Services.
7. Intellectual Property
7.1 All content, features, functionality, software, and materials available through the Services are owned by A Plus Services LLC DBA as Rocket Boyz or its licensors and are protected by copyright, trademark, and other intellectual property laws.
7.2 You may not copy, modify, distribute, sell, or lease any part of our Services without our prior written consent.
8. Third-Party Services
8.1 Our Services may integrate with or contain links to third-party platforms, including but not limited to Yelp, Google, Meta, and CRM platforms. We are not responsible for the content, privacy practices, or terms of any third-party services.
8.2 Your use of third-party services is at your own risk and subject to the terms and conditions of those third parties.
9. Payment Terms
9.1 Certain Services may require payment of fees. All fees are stated in your service agreement or order form. Unless otherwise specified, fees are non-refundable.
9.2 We reserve the right to change our fees upon 30 days’ written notice. Failure to pay fees when due may result in suspension or termination of your access to the Services.
10. Limitation of Liability
10.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, A PLUS SERVICES LLC DBA as Rocket Boyz SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR USE OF OR INABILITY TO USE THE SERVICES; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES; OR (D) ANY BUGS, VIRUSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY.
11. Disclaimer of Warranties
11.1 THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Indemnification
12.1 You agree to indemnify, defend, and hold harmless A Plus Services LLC DBA as Rocket Boyz , its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit or transmit through the Services.
13. Termination
13.1 We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services will immediately cease.
13.2 All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
14. Governing Law
14.1 These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
14.2 Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Orange County, California.
15. Changes to Terms
15.1 We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on our website. Your continued use of the Services after such notification constitutes your acceptance of the updated Terms.
